2. Eligibility and Scope

These Terms apply to all purchases and interactions conducted through our U.S. website or authorized boutiques.
By using our Services, you represent that you are at least 18 years of age and a resident of the United States. If you are purchasing on behalf of a company, you warrant that you are authorized to bind that entity to these Terms.

3. Product Information and Availability

  • Our timepieces are crafted in limited quantities, and availability may change without notice.

  • We take the utmost care to ensure that all descriptions, images, and prices are accurate; however, minor variations may occur.

  • In the event of a typographical or pricing error, we reserve the right to correct the information and cancel or refuse any order placed under such error prior to shipment.

4. Orders and Acceptance

  • All orders placed through our website or Customer Care team constitute an offer to purchase.

  • An order is accepted only upon your receipt of an Order Confirmation email and payment authorization.

  • We reserve the right to refuse or cancel any order at our sole discretion, including for suspected fraud, supply limitations, or breach of these Terms.

5. Pricing, Payment, and Taxes

  • All prices are displayed in U.S. Dollars (USD) and are exclusive of sales tax, which will be calculated at checkout based on the shipping address.

  • We accept only the payment methods listed during checkout. Payment must be authorized at the time of purchase.

  • The customer is responsible for any applicable state or local use tax not collected at checkout.

6. Shipping and Delivery

  • We ship only to valid U.S. addresses (excluding P.O. boxes, freight forwarders, and certain territories).

  • All shipments are insured and require an adult signature upon delivery.

  • Delivery times are estimates and not guarantees.

  • Title and risk of loss transfer to you upon confirmed delivery to your address.

7. Returns and Refunds

  • Returns are governed by our Order Return Policy.

  • Only watches meeting our strict condition and authenticity criteria are eligible for return.

  • Refunds are issued to the original method of payment or mailed check following inspection and approval.

  • We do not accept returns of customized, engraved, or special-order pieces.

8. Warranty and Servicing

  • Each watch is accompanied by an International Limited Warranty valid from the date of purchase.

  • The warranty covers manufacturing defects only and excludes damage caused by misuse, accidents, or unauthorized service.

  • Warranty service must be performed exclusively at an authorized Avoirdupois Service Center.

  • For full details, refer to the Warranty Card provided with your timepiece.

9. Intellectual Property

All content on our website—including but not limited to product designs, trademarks, photographs, videos, and text—is the intellectual property of Avoirdupois or its affiliates and licensors.
No reproduction, modification, or redistribution is permitted without prior written consent.

10. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Avoirdupois shall not be liable for indirect, incidental, or consequential damages, including loss of profit, goodwill, or data.

  • Our total liability for any claim shall not exceed the amount paid for the product giving rise to the claim.

  • Some states do not allow the exclusion or limitation of incidental or consequential damages, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Avoirdupois, its affiliates, officers, employees, and agents from any claims, losses, liabilities, or expenses arising from your breach of these Terms or misuse of the Services.

12. Data Protection and Privacy

We respect your privacy and are committed to protecting your personal information. All data collected is handled in accordance with our Privacy Policy.
By using our Services, you consent to such collection and processing in the United States.

13. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles.

  • Any disputes arising under or relating to these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to the jurisdiction of such courts.

  • You waive any right to participate in a class action against Avoirdupois.

14. Changes to These Terms

We may modify these Terms from time to time. Updates will be posted on this page with the “last updated” date. Your continued use of our Services after such changes constitutes your acceptance of the revised Terms.
