Expiration: All estimates and quotes are valid for a period not to exceed seven (7) days.

 

Delivery: All prices are F.O.B. Avoirdupois, LLC New York, New York and are subject to change without notice. A minimum deposit is required with all orders. Custom orders may require a deposit of 100%. Delivery schedules are determined per order, should there be any delay, Avoirdupois, LLC will notify the purchaser of when to expect shipment.

 

Claims: Claims for damages, shortages or nonconforming goods must be filed with Avoirdupois, LLC within fourteen (14) days after shipping. Claims for incorrect invoices must be made in writing to Avoirdupois, LLC within fourteen (14) days after receipt of invoice. The purchaser waives any right to hold back amounts paid or due hereunder against any other amount.

 

Returns: Avoirdupois, LLC will accept returns for credit on any new merchandise shipped in error or which, upon inspection, is found to be defective in workmanship or materials. For non-customized items returned in perfect condition there will be a handling and restocking charge of 50%. Such returns must be sent by freight prepaid. Customized items, special finishes, materials fabricated to order, custom upholstery including custom fabric selected by the purchaser or non-customized items over fourteen (14) days old from shipping date, or items visibly used or worn will not be accepted for credit.

 

Force Majeure: Avoirdupois, LLC shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lock-outs or other serious labor disputes, riots, earthquakes, floods, explosions or other acts of nature.

 

Limitation of Liability: The purchaser acknowledges and agrees that Avoirdupois, LLC will not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the purchaser has been advised or otherwise might have anticipated the possibility of such loss or damage.

 

Payment Information: No order will be processed without a non-refundable deposit. The balance is due within 30 days of receipt of final invoice and required prior to shipment of goods.

 

Tax Information: Any sales, use, excise or other taxes or duties imposed upon the sale of the merchandise will be invoiced and are the responsibility of the purchaser.

 

Acceptance: Avoirdupois, LLC is here authorized to furnish all materials and labor to complete the work or items mentioned in the above order. By remitting payment, you the purchaser agree to the above terms of this sale.
